Custody spat could stall Lauren & Simon’s Miami move

Lauren Silverman may have her heart set on moving to Miami with “The X Factor” judge Simon Cowell and their new baby, due in February, but a custody deal over her son, Adam, could keep her in New York.

Sources tell us Silverman wants to move permanently to Florida with Cowell and her family, but she can’t bring Adam, 7, her son with ex-­husband Andrew Silverman, because of their current custody deal.

“She wants to move to Miami, where her parents live, but she can’t because her son lives here. And she can’t take Adam out of the state, per her custody agreement,” said a source.

Pregnant Lauren, 36, who left Silverman after hooking up with Cowell, 54, earlier this month finalized her divorce — which stipulated that she not take Adam out of New York, where he lives with his father and attends school.

Moreover, a clause in the settlement states that Cowell cannot be around Adam at all — or Lauren has to pay Andrew a $50,000 fine. That clause, however, expires in January 2015.

Page Six reported in November that Silverman and Cowell were overheard in a Miami restaurant “talking about property . . . [and] the number of bedrooms they would need,” a spy said.

Cowell is selling one of his LA pads and looking for a more “family-friendly” home to prepare for the arrival of his son, who reportedly will also be named Simon. We’re told the couple plan for the birth to take place in New York City.

We also hear that music and TV mogul Cowell, who also owns a production company, Syco, has hired Lauren’s father — who lives in Miami and is divorced from Lauren’s mother — as an assistant.

Lauren’s lawyer Bernard Clair said, “Details of the divorce settlement are private and confidential,” and he would not respond to “irresponsible individuals who are apparently invested in sowing misinformation to the media and public.”

A spokesperson for Lauren says, “She’s never looked at moving to Miami permanently.” A rep for Cowell said, “Lauren’s father is not working for Simon.”
