Exclusive: Anthony Marshall could already be paroled from prison

Break out the bed pans! Anthony Marshall’s coming home if he and his wife, Charlene, get their way. It’s been less than two months since the 88-year-old was wheeled into custody on a one-to-three-year prison term for stealing millions from his philanthropist mother, Brooke Astor, and already Charlene is stocking up on oxygen tanks and other supplies for a homecoming, Page Six has learned. Charlene — dubbed “Miss Piggy” by Astor’s nurses — may have some cause for hope, reports The Post’s Laura Italiano. State correction officials confirmed yesterday that Marshall’s legal team has formally applied for medical parole from Fishkill Correctional Facility in Elmira and a court hearing is set for Aug. 19. A source close to Marshall said, “Anthony is dying, and he is in a lousy state prison. He has a new doctor’s letter stating he is even worse than a few months ago. He has very bad heart concerns. He is incontinent. It could be weeks or months or days.” Manhattan Supreme Court Justice A. Kirke Bartley is not expected to oppose parole. He earlier said he’d rather not jail the World War II vet but was bound under mandatory sentencing rules. Prosecutors argue that Marshall’s ill health and war record don’t compensate for grand larceny and conspiracy for granting himself $2 million for “managing” his Alzheimers-addled mother’s finances while swindling her into signing over millions. His lawyer, William B. Zabel, said, “It is a disgrace for Tony not to be allowed to die in peace in his own home.”
