Christina Aguilera will not be charged for public intoxication

Christina Aguilera’s long-running, post-divorce party landed her in the West Hollywood Sheriff’s office early this morning.

The singer was arrested for public intoxication and boyfriend Matthew Rutler was nabbed for driving under the influence.

The two were picked up at 2:45 a.m., TMZ.com reported.

A few hours later, Aguilera was released from jail and authorities said they don’t plan to seek criminal charges.

“She was not capable of taking care of herself,” said Steve Whitmore, a spokesman for the L.A. County Sheriff’s Office.

He said the singer was booked and placed in a cell, but will not be charged.

“She was not belligerent in any way,” he said. “We have no desire to prosecute.”

Whitmore said arresting Aguilera was a “public safety issue” and that it is routinely done.

Los Angeles County sheriff’s Deputy Bill McSweeney said the 30-year-old singer was in a car driven by her boyfriend that was stopped on a West Hollywood street.

A law enforcement source said Aguilera appeared to be “extremely intoxicated” and “unable to take care of herself,” according to TMZ.

Aguilera wouldn’t have been arrested if Rutler hadn’t been caught, a source told TMZ.

Aguilera was released out a back gate at about 7:30 a.m., avoiding paparazzi who were waiting near the front entrance to the police station.

Rutler, 25, was booked on suspicion of driving under the influence. He remains jailed on $5,000 bail.

Calls to Aguilera’s agent and publicist weren’t returned.

Aguilera’s problems since her split from music exec Jordan Bratman late last year have played out in public.

At the Super Bowl, Aguilera flubbed lines of the National Anthem.

Just days later she nearly fell at the Grammy Awards.

Meanwhile in a less public forum, she reportedly showed up uninvited a Jeremy Renner’s birthday party and then passed out in his bed.

US Weekly has reported that her drinking is “out of control” and TMZ reported this morning that friends are trying to get her into rehab.
